Terms of Service
These Terms of Service ("Terms") govern your use of the Locals iOS app and related services, including the web pages that show a shared Collection ("Locals"). By creating an account you agree to these Terms. If you do not agree, do not create an account or use Locals.
1. Who You Are Contracting With
Locals is provided by Danila Gorbunov, a private individual and the publisher of the Locals app, as shown as the seller on the App Store. These Terms are an agreement between you and Danila Gorbunov. "We", "us", and "our" in these Terms refer to Danila Gorbunov. Locals is not operated by a company.
2. Who Can Use Locals
You must be 18 years of age or older to create an account and use Locals. When you accept these Terms you confirm that you are. We do not verify your age beyond that confirmation, and we will close an account we learn belongs to someone under 18.
You may use Locals only where doing so is lawful for you. You must not use Locals if you are barred from receiving it under the laws that apply to you.
3. Locals Is Free
Locals is free to download and use. It has no subscriptions, in-app purchases, or other paid features, and we do not ask you for payment information.
If paid features are ever introduced, these Terms will be updated before they are offered, and nothing will be charged without your separate agreement through the App Store.
4. Your Account
- You can create an account with Sign in with Apple, with Google Sign-In, or with an email address and password. Everything in Locals requires an account.
- You choose a username when you create your account. It is shown to other people next to the content you publish. Do not choose a username that impersonates another person, brand or business, or that is offensive.
- Keep the information in your account accurate and keep your sign-in method secure. You are responsible for what happens under your account. Tell us at support@localsapp.app if you believe someone else has access to it.
- One person, one account. Do not create accounts for others or by automated means.
5. Your Content
What your content is
"Your content" is what you create in Locals: Collections, Place Cards, Trips, the titles, descriptions and tips you write, the photos you upload, and your profile (username, name, bio and profile photo). You keep ownership of your content.
Place facts that Locals shows next to your content โ a place's name, address, category, coordinates and photos supplied by Google Places โ are not your content and are not ours. They remain subject to the terms of their provider. See section 9.
Who sees it
- A Collection is either private or public. A private Collection is visible only to you. A public Collection is visible to every Locals user, including on the Explore map, and to anyone who opens its share link, while it stays public.
- A Place Card carries its own private or public setting, independent of the Collections that hold it.
- Your profile, and your public Collections, Place Cards and Trips, are visible to other Locals users. When you save someone else's public Collection, its owner can see that you saved it.
- A saved Collection is a link to the original, not a copy. If its owner makes it private, deletes it, or it is removed under section 7, it is no longer available to the people who saved it.
The licence you give us
To run Locals we need your permission to handle your content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, reproduce, process, adapt (for example, resize a photo or reformat text for a screen), display and distribute your content, only for the purpose of operating, providing, securing and improving Locals โ for example, showing a public Collection to other users, on the Explore map, and on the web page its share link opens. We do not sell your content and we do not use it in advertising.
The licence ends for a piece of content when you delete it or delete your account, except that copies may remain for a limited time in backups, and except where we must keep content to comply with the law, to resolve a dispute, or because it was removed under section 7 and the removal is still open to appeal.
What you promise about your content
You confirm that you have the rights needed to publish your content and to grant the licence above, including the rights to every photo you upload, and that your content does not break these Terms or the law. If your content includes another person's personal information, you are responsible for having a lawful basis to share it.
6. Acceptable Use
Do not use Locals to publish or do any of the following:
- Spam: repeated promotion, misleading links, or fake offers.
- Harassment: targeted insults, threats, or unwanted contact.
- Hate: attacks on people for who they are.
- Impersonation: claiming to be another person, brand or business.
- Inappropriate content: content that does not belong in a library of places, including sexual content, graphic violence, and content that promotes self-harm.
- Content that infringes someone else's copyright, trademark or other rights, or that reveals another person's private information without their permission.
- Anything illegal, or that promotes or helps illegal activity.
You also must not:
- scrape, harvest or bulk-download content or data from Locals, or access it by automated means other than the app;
- interfere with or disrupt Locals, test or bypass its security, or reverse-engineer it except where the law allows this despite this restriction;
- misuse reporting, for example by filing reports you know to be false;
- use Locals in a way that breaks the terms of the services it relies on, listed in section 9.
7. Reports, Blocking and Removal
- Reporting. You can report a Collection, a Place Card, a Trip or a user that you believe breaks section 6, choosing one of the grounds listed there. A report about a place's facts being wrong or out of date is not a report and is not reviewed as one.
- What a report does at once. The reported item is hidden for you straight away, and for nobody else. You can see and unhide what you hid in your account settings.
- Review. Every report is read by a person. No number of reports removes content automatically. We aim to review reports within 24 hours.
- Removal. If we find that content breaks these Terms, we remove it for everyone. People who saved it see that it is no longer available, without a reason. When the content is removed repeatedly, or when the ground is harassment, hate or impersonation, we also review the account and may act under section 8.
- What the author is told. If your content is removed, you see in the app what was removed, on which ground and when. We never tell you who reported it, how many reports there were, or what a reporter wrote.
- Appeal. If you believe a removal is wrong, write to support@localsapp.app. A removal can be reversed.
- Blocking. You can block another user. Neither of you then sees the other's profile or content. Blocking is private and the other user is not told.
- Copyright. Notices about content that infringes your rights follow the Copyright and Takedown Policy.
We may also remove content or restrict access to it where the law requires us to, or where we receive a valid order from a competent authority.
8. Ending Your Use of Locals
- You can stop using Locals at any time, and you can delete your account in the app, from account settings. Deleting your account deletes your content as described in the Privacy Policy.
- We may suspend or close your account, or remove your content, if you seriously or repeatedly break these Terms, if you repeatedly infringe other people's rights, if the law requires it, or if your use creates a risk of harm to other users or to Locals. Where it is lawful and safe to do so, we will tell you why, and you can contest the decision at support@localsapp.app.
- We may stop providing Locals, in whole or in part. If we stop providing it entirely, we will give reasonable notice in the app where we can, so that you have time to look at your content.
- Sections 5 (for content already shared), 10, 11, 12 and 14 continue to apply after these Terms end.
9. Third-Party Services and Content
Locals relies on services provided by other companies. What each one receives and provides is described on the Third-Party Services page.
Google Maps
Locals includes Google Maps features and content. Place search results, place details and place photos come from Google Maps Platform. Your use of Google Maps features and content is subject to the then-current versions of the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
Other services
- Maps in Locals are drawn by Mapbox, using map data from OpenStreetMap contributors. Their attribution is shown on the map.
- If you sign in with Apple or Google, your use of that sign-in is also subject to Apple's or Google's own terms.
We do not control third-party services or the content they supply, and we are not responsible for them. Place information supplied by them, or written by other users, may be incomplete, out of date or wrong.
10. Disclaimers
Locals is a free service provided "as is" and "as available". To the extent the law allows, we make no promise that Locals will be uninterrupted, error-free or available in your country, or that any content in it is accurate, complete or current.
Content in Locals is written by its users and by third parties. It is not advice and it is not endorsed by us. Whether a place is open, safe, legal to visit or suitable for you is your own judgement: check before you go, and follow local laws and signs when you get there.
11. Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, and to the extent the law allows: we are not liable for indirect or consequential loss, loss of data, or loss of profit or opportunity; we are not liable for the content of other users or third parties, or for anything that happens when you visit a place; and because Locals is free, our total liability to you for all claims relating to Locals is limited to EUR 50.
If you are a consumer, you have rights under the law of the country where you live that a contract cannot take away. These Terms do not affect those rights.
12. Apple
These Terms are between you and us, not Apple. Apple is not responsible for Locals or its content, has no obligation to provide maintenance or support for it, and is not responsible for any claim by you or a third party relating to Locals, including product liability claims, claims that Locals fails to meet a legal or regulatory requirement, consumer protection claims, and claims that Locals infringes someone's intellectual property. If Locals fails to conform to an applicable warranty, you may notify Apple; because Locals is free, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm that you are not located in a country subject to a United States government embargo, and that you are not on a United States government list of prohibited or restricted parties.
13. Changes to These Terms
We may update these Terms, for example when Locals changes or the law requires it. Each version carries a version identifier and a "last updated" date at the top of this page, and your account records the version you accepted. If a change is material, we will tell you in the app before it takes effect and, where the law or the change requires it, ask you to accept the new version before you continue to use Locals.
14. General
- If any part of these Terms is found unenforceable, the rest stays in effect.
- If we do not enforce a part of these Terms straight away, we can still enforce it later.
- You may not transfer your rights under these Terms to someone else. We may transfer ours to a person or company that takes over Locals, and we will tell you if that happens; that does not reduce your rights.
- These Terms, together with the documents they link to, are the whole agreement between you and us about Locals.
